1. Agreement to Terms
By accessing or using Salesika ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Salesika is an AI-powered sales agent platform that allows businesses to deploy intelligent chatbots trained on their website content.
2. Description of Service
Salesika provides a platform that crawls your website, generates AI embeddings from your content, and deploys a customizable chat widget to your site. The chat widget uses retrieval-augmented generation (RAG) to answer visitor questions and capture leads on your behalf.
3. Account Registration
You must create an account to use Salesika. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@salesika.com of any unauthorized use of your account.
4. Free Trial
New accounts receive a 7-day free trial with Scout plan limits (1 site, 2,000 chats/month). No credit card is required to start a trial. At the end of the trial period, continued access requires a paid subscription. We reserve the right to modify or cancel trial offers at any time without notice.
5. Subscriptions and Billing
Salesika offers the following paid subscription plans:
- Scout – $39/month or $29/month billed annually
- Agent – $79/month or $59/month billed annually
- Agency – $159/month or $109/month billed annually
Subscriptions automatically renew at the end of each billing cycle unless cancelled. Payments are processed by DodoPayments. We do not store your payment card details. You may cancel your subscription at any time through your account settings or by contacting support.
We reserve the right to change subscription pricing with reasonable notice. Price changes take effect at the start of your next billing cycle.
6. Refund Policy
All sales are final. We do not offer refunds for partial billing periods or unused portions of a subscription. If you believe you were charged in error, contact us at support@salesika.com within 14 days of the charge.
7. Usage Limits and Fair Use
Each plan includes defined limits for the number of sites and monthly chats. Exceeding these limits may result in service throttling or temporary suspension until your next billing cycle. You may not share account credentials or attempt to circumvent usage limits. Accounts found in violation may be suspended without refund.
8. Acceptable Use
You agree not to use Salesika to:
- Violate any applicable laws or regulations
- Collect or process personal data in violation of applicable privacy laws
- Deploy chat agents on websites you do not own or have authorization to modify
- Transmit spam, malware, or any harmful content through the widget
- Impersonate any person or entity
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the service for any illegal, deceptive, or fraudulent purpose
- Reverse engineer, decompile, or attempt to extract source code from the Service
9. Your Content
You retain ownership of all content on your website that is crawled and indexed by Salesika. By using the Service, you grant Salesika a limited, non-exclusive license to crawl, process, and store your website content solely for the purpose of operating the Service for you. You represent that you have the right to grant this license and that your content does not infringe any third-party rights.
10. Intellectual Property
Salesika and its licensors own all rights, title, and interest in and to the Service, including all software, designs, trademarks, and content created by Salesika. Nothing in these Terms grants you any right to use Salesika's intellectual property except as necessary to use the Service as permitted herein.
11. Third-Party Services
Salesika relies on the following third-party services to operate:
- Clerk – Authentication and user management
- Neon – Database hosting (PostgreSQL)
- Google Gemini – AI model for embeddings and chat responses
- Upstash / QStash – Background job processing
- DodoPayments – Payment processing
- Vercel – Application hosting
Your use of the Service is also subject to the terms of these third-party providers. We are not responsible for the actions or policies of these providers.
12. AI Features, Limitations, and Responsibilities
12.1 Nature of AI Responses
Salesika uses large language models (Google Gemini) to generate responses. AI-generated content may be inaccurate, incomplete, outdated, or misleading — a phenomenon commonly known as "hallucination." Salesika does not guarantee the accuracy, completeness, or reliability of any AI-generated response delivered through the chat widget.
12.2 Your Responsibility for AI Outputs
You are solely responsible for the content your AI agent delivers to your visitors. Before deploying the widget on your site, you should test it thoroughly and ensure it does not provide harmful, misleading, or legally problematic responses. You must not deploy the agent as a substitute for professional advice in fields including but not limited to medicine, law, finance, or mental health.
12.3 Prohibited AI Uses
You may not use Salesika to deploy AI agents that:
- Provide medical diagnoses, treatment recommendations, or health advice as a primary source
- Provide legal advice, legal opinions, or act as a substitute for a qualified attorney
- Provide financial advice, investment recommendations, or act as a substitute for a licensed financial advisor
- Generate, distribute, or promote illegal, defamatory, discriminatory, or harmful content
- Impersonate real individuals or organizations in a deceptive manner
- Manipulate or deceive visitors in ways that damage their interests
- Engage in unauthorized data collection or violate visitor privacy
- Collect, store, or transmit Protected Health Information (PHI) as defined under HIPAA without a signed Business Associate Agreement with Salesika
12.4 AI Content Moderation
We reserve the right to suspend or terminate any agent that we determine, in our sole discretion, is generating harmful, illegal, or abusive content — regardless of whether such content originated from your website data or from AI model behaviour. We may act without prior notice in cases where immediate harm is possible.
12.5 We Do Not Train on Your Data
Salesika does not use your website content, visitor conversations, or lead data to train our own AI models. Your content is used solely to generate embeddings and retrieve context for your agent's responses. However, your data is processed by Google Gemini as described in our Privacy Policy and subject to Google's API usage policies.
12.6 AI Service Availability
AI response quality and availability depend on third-party AI providers (currently Google Gemini). We are not liable for degraded performance, model changes, or service interruptions caused by upstream AI providers. We may change the underlying AI model at any time to maintain or improve service quality.
13. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. You assume all risk arising from your use of AI-generated content delivered through the widget.
14. Limitation of Liability
To the maximum extent permitted by law, Salesika and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
15. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, if we believe you have violated these Terms. You may terminate your account at any time by cancelling your subscription and contacting us to delete your account. Upon termination, your data will be deleted within 30 days.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by email or by displaying a notice in the dashboard. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
